TERMS AND CONDITIONS
These Conditions are incorporated in the offer and in the order confirmation through this reference and
constitute an integral and substantial part of it.

These General Conditions constitute the sole basis of the relationship between the parties. Customers are
required to read them before placing an order. Validation of the order implies acceptance of these General Conditions without restriction or reservation. It is also clarified that should one or more of the provisions of these General Conditions prove to be null and void, the other provisions will continue to apply.

Customers are responsible therefore for checking the accuracy of the order before sending it to Stefania
Posa.
We do not warrant and will not be liable to you for any inaccurate or illegible Customer Content and
will not be held responsible for errors or omissions arising from inaccurate or illegible Customer Content.
Ambiguities in the text to be translated shall release Stefania Posa from any liability whatsoever.

Unless otherwise agreed, We will supply the deliverables pursuant to the Order to You by e-mail or via a
software platform or such other agreed form of delivery. If the deliverables pursuant to the Order are to be
delivered by way of post or courier then this will be specified in the Order. We will not be liable to You or to
any third-party for any failure or delay arising out of a failure, delay, error, or omission caused by a postal
service or courier in supplying the deliverables pursuant to the Order.

Where You provide Us with Customer Content for the purpose of notarisation, legalisation, apostille or for
any other governmental validation, verification, authentication, or otherwise then You accept and
acknowledge that We cannot be liable to You for any rejection or delay caused by a governmental agency.

We reserves the right, in the event of non-compliance of payment, to suspend or cancel provision of
Services ordered by the Customer.

Stefania Posa shall not be liable for damage to or loss of documents, information or data carriers made
available by the Client. The Contractor shall neither be liable for damages arising as a result of the use of
information technology, internet, and means of telecommunication or as a result of the transport or the
despatch of information, including the risk or the consequences of viruses, Trojan horses, spam email or the like.
The Contractor shall not be liable for any other forms of damages, e.g. trading losses, consequential
damages, and lost profit, of the Client or of third parties. The Contractor releases itself from any and all
liability for ambiguous elements in the source text.
The Customer is liable to ensure that the material submitted to Sworn Translation Services and subsequent handling of such material does not infringe on the intellectual property rights of third parties.
The Customer shall indemnify Stefania Posa for any claims made by a third party in connection with an
assignment carried out by Stefania Posa on behalf of the Customer. In any case the liability Stefania Posa is limited to an amount equal to the agreed total value of the assignment.

We reserve the right to suspend or postpone the date of delivery or to cancel the Services You have
ordered (without liability to You) if We are prevented from or delayed in performing the Contract due to
circumstances beyond Our reasonable control including, without limitation, acts of God, governmental
actions, war or national emergency, acts of terrorism, protests, riot, civil commotion, fire, explosion, flood,
epidemic, lock-outs, strikes or other labour disputes, telecommunication or network disruption, or denial of service, transport disruptions, malfunctions in our network, servers or data transmission, or any
interruption that is outside our responsibility.
These General Conditions will be governed by and construed in accordance with the laws of Italy.
Any dispute arising out of or relating to the formation, validity, interpretation, execution and/or
termination of these Conditions, shall solely and exclusively be settled by the Courts of Catania and the
parties hereby irrevocably consent to the personal jurisdiction and venue therein.

If one or more clauses of these General Conditions will be declared null and/or invalid, this will not
determine the invalidity of the entire Agreement.
